The Petitioner seeks a direction to Respondent no.3 to transfer the investigation in CR No.15 of 2015. Learned counsel for the Petitioner submitted that investigation has not been conducted properly in FIR No.15 of 2015 registered under Sections 120(b), 153(A), 342, 506, 34 and 323 of Indian Penal Code. He further submitted that `B' summary report has been filed in the Court by the investigating officer. He further submits that the Petitioner has received notice of filing of summary from the Court. 2.

In view of filing of `B' summary report, keeping all issues open, we observe that the Petitioner may contest the said summary proceedings by filing appropriate protest petition.

We direct that concerned Magistrate shall pass appropriate final orders on `B' summary proceedings at the earliest on its own merits. Writ Petition stands disposed of.
