The learned Counsel for the applicant submits that charge-sheet has been filed, after filing of the present application. In view of the same, he seeks leave of the Court to withdraw the application with liberty to file a fresh application before the appropriate Court. 2.

Accordingly, application is allowed to be withdrawn with liberty as prayed.

It is made clear that this Court has not considered the application on merits and if an application is filed before the appropriate Court, the same shall be heard on merits, uninfluenced by the withdrawal of the present application.

Since the applicant is a women, senior citizen and is suffering from various ailments, the appropriate Court shall decide the application, as expeditiously as possible and preferably, within fifteen days from the receipt of this order.

The Application is disposed of accordingly.
