The respondent No.2 is present in person. The respondent No.2 demonstrates before this Court that the petitioner herein had made several attempts to quash the proceedings filed against him. This Court had declined to stay the proceedings and hence the prosecution has closed its case and has submitted the final arguments. It is specifically submitted that it is in these circumstances that the petitioner has not appeared before the Court.

The Farad Sheet would show that none appeared for the petitioner on 29.2.2016. The order dated 27.4.2016 passed by the Coordinate Bench presided over by the Hon'ble Justice A.S.Gadkari is self-explanatory. On 5.7.2016, the matter was listed on board and the respondent No.2 had requested the Court to place the matter on board today since it had not reached upto 5.35 p.m. Today also none appears for the petitioner. The matter stands dismissed for want of prosecution. 4.
