Learned Counsel for the Applicant states that the Applicant will avail the alternate remedy to approach the Court of Sessions by filing the Revision Application against the impugned order, passed by the Magistrate, requesting to discharge the Applicant. The Revision Application would be maintainable. 2.

Considering these submissions, the Application is allowed to be withdrawn with such liberty to the Applicant to approach the Court of Sessions by filing Revision Application against the impugned order. If the question of limitation is raised, Ashwini V

22-APL-145-2023 the said Court shall take into account the fact that the Applicant had preferred the present Application before this Court. If such Revision Application is filed, it shall be decided in accordance with law without being influenced by this order of withdrawal of this Application.

With this liberty the Application is allowed to be withdrawn and is disposed of.
