Mr. Kocharekar, learned counsel for the Applicant submits that the Sessions Court has granted bail to the co-accused. Hence, the Applicant wishes to file a fresh Application before the Sessions Court on the ground of parity. He therefore seeks leave to withdraw the Application. Leave with liberty is granted. Bail Application stands dismissed as withdrawn. It is made clear that this Court has not gone into the merits of the matter. In the event fresh Application is filed, the same shall be decided on its own merits.
