Heard the learned counsel for the applicant and the learned Prosecutor for the State.

Prosecution case in brief, is that at the behest of the applicant, accused no.4-Saroj kidnapped Vikas, two and half year old boy from the custody of the complainant and sold him to the applicant. Applicant was arrested on 22nd September, 2020. Investigation in the case is over and the Shivgan 1/3

charge-sheet has been fled.

As of today, the child is in custody of his biological mother. Primary evaluation of the charge-sheet does not suggest, applicant's complicity in kidnapping of the child.

Be that as it may, applicant is 28 years old lady with no criminal antecedents. Trial may not commence in near future. However, her presence for the trial can be secured by imposing the conditions.

For these reasons, application is granted and she is directed to be released on bail on executing PR bond for the sum of Rs.25,000/- with one or more sureties in like sum.

The applicant shall furnish her permanent residential address and contact number to the Investigating Shivgan 2/3

Officer within seven days from the date of his release on bail.

The application is accordingly allowed and disposed of.

It is made clear that observations made here-inabove be construed as expression of opinion for the purpose of bail only and the same shall not in any way influence the trial in other proceedings.
