Heard the learned counsel appearing for the Petitioner and the learned counsel appearing for the Respondents. 3.

The learned counsel appearing for the Petitioner on instructions states that permissions have been granted to the Petitioner for taking out a rally on 9th March 2015 by the Commissioner of Police, Thane and by the Deputy Commissioner of Police (Traffic), Navi Mumbai. He states that a permission is not yet granted by the Commissioner of Police, Mumbai. The learned AGP has placed on record a communication dated 4th March 2015 addressed to him by the office of the Commissioner of Police, Mumbai in which it is stated that

appropriate decision will be taken and the same will be communicated to the Petitioner tomorrow. We accept the said statements in the letter. The said letter is taken on record and marked "X" for identification. 4.

Hence, we dispose of the Petition by passing the following order:

ORDER :

(a) We accept the statements made in the letter dated 4th March 2015 which is taken on record and marked "X" for identification;

(b) It is obvious that as the Petitioner has been permitted to take out rally as prayed, necessary police protection shall be granted to the rally by all the concerned (Commissionerate of Police, Thane and Commissionerate of Police (Traffic), Navi Mumbai). If permission is granted to the Petitioner by the Commissioner of Police at Mumbai, necessary police protection shall be provided to the Petitioner's rally by the Commissionerate of Police at Mumbai;

(c) It is made clear that the police protection shall be granted in accordance with the policy of the State Government subject to payment of charges, if any; (d) All concerned to act upon an authenticated copy of this order;

(e) The Petition is disposed of on above terms.
