Heard the learned Counsel for the applicant and the learned APP for State.

This is an application seeking temporary relaxation of the condition imposed upon the applicant while granting pre-arrest bail 1/4

that during the period of interim protection, the applicant shall not leave Mumbai, Navi-Mumbai and Thane District. The application seeking pre-arrest bail is pending before this Court. The learned Counsel for the applicant submits that the applicant has to leave for Delhi for a business meeting, more particularly to met Mr. Sandeep Gupta, Vice President, F & A, Shalimar Paints Ltd for discussion during the period between 10/2/2017 to 12/2/2017. The learned Counsel for the applicant upon instructions from the applicant submits that in the eventuality that the relief is granted, the applicant undertakes to attend Gurgaon Police Station on 10th and 11th February, 2017 during 5 p.m. to 7 p.m.

Taking into consideration the short period for which relaxation of conditions is sought, the application deserves to be allowed without going into merits of the matter.

Hence, following order is passed :

ORDER

(i) The application is allowed.

(ii) The applicant herein is permitted to travel to Delhi and stay at Delhi during the period between 10/2/2017 to 12/2/2017. (iii) The applicant shall cause his appearance before the Gurgaon Police Station between 5 p.m. to 7 p.m..

(iv) The applicant shall report to the Office of Economic Offences Wings, Unit-9 on 13/2/2017 at 6 p.m..

It is further clarified that the rest of the conditions are not relaxed and this is temporary relaxation of condition. 3/4

Leave to add/amend in the main application i.e. ABA 1977/2016.
