This application is moved for restoration of the First Appeal. The learned Counsel for the applicant submits that this appeal was admitted by this Court vide order dated 29.9.2010 and the appelalnt was directed to file private paperbook. The learned Counsel submits that accordingly, the appellants had filed paperbook within the stipulated period. However, copies of the memo of First Appeal were not supplied and, therefore, by order dated 24.9.2014, the appeal was dismissed. 2.

Mr.Mendon is appearing for the respondent.

In view of the submissions of the learned Counsel for the parties, the order dated 24.9.2014 is set aside. Appeal is restored to file. The 1 / 2
