This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.157 of 2022 registered at Indiranagar Police Station, Nashik for the ofences punishable under Sections 328, 389,392, 419 and 420 read with 34 of the Indian Penal Code.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

According to the prosecution, on the date of incident, which took place on 14 September 2022, the present applicant took the complainant to some isolated place on the pretext of showing him the car which he wanted to sell him. 911-ba-413-23-s.m.-19-6.doc started feeling giddiness. It is alleged that thereafter in semi-nude condition his photographs were taken with one girl. It is alleged that the present applicant and other co-accused had then threatened the complainant to involve him in false case of attempt to rape and extorted Rs.95,000/- 5.

There is delay of 14 days in lodging the report. The applicant is in jail for six months. There are no other criminal antecedents. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 157 of 2022 registered at Indiranagar Police Station, Nashik for the ofences punishable under Sections 328, 389,392, 419 and 420 read with 34 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
