This writ petition challenges an order passed by the Industrial Court at Pune in a complaint of unfair labour practice. After the matter is heard at some length, it is agreed between learned Counsel for the parties that the impugned order dated 29 January 2020 may be set aside and the complaint be remitted to the Industrial Court at Pune for a fresh hearing in accordance with law. The impugned order dated 29 January 2020 is, accordingly, quashed and set aside and the Petitioner's application (Exhibit U-2) in Complaint (ULP) No.259 of 2019 is remitted to the Industrial Court at Pune for fresh hearing in accordance with law. The ad-interim stay of the transfer order dated 16 September 2019 operating during the pendency of Exhibit U-2 shall continue to operate. The Industrial Court is requested to dispose of the application as expeditiously as possible and preferably 1 / 2

sat wp 1747-2020.doc within a period of six weeks from today. Both parties may, to that end, appear before the Industrial Court on 6 March 2020 at 11.00 a.m. and produce an authenticated copy of this order. The Industrial Court may thereupon fix a schedule of hearings and dispose of the complaint accordingly. It is made clear that this court has not applied its mind to the merits of the transfer order impugned before the Industrial Court, but that the order is passed purely on concession by the parties considering particularly that the reasons for the order are not properly stated in it.
