The learned counsel for the Applicant on instruction seeks leave to withdraw the Civil Application No. 562 of 2017. However, he submits that the Applicant's belongings are in the said flat of which the possession has been taken by the Respondent. The learned counsel for the Respondents-BEST submits that if there are any belongings of the Applicant in the said flat, the same will be returned.

In view of the aforesaid, we permit the Applicant to make appropriate application before the Competent Authority of Vishal Parekar 1/2

5-caw-562-2017.doc Respondents-BEST for return of his belongings. We are sure that in case such application is made by the Applicant, the same shall be considered and if any belongings of the Applicant are there, the same will be returned to the Applicant.
