Heard the learned Counsel appearing for the respective parties.

The petition is filed for quashing the FIR bearing CR. No. 44 of 2016 registered with Shahupuri Police Station, Kolhapur. Mr. Yagnik, the learned APP, on instructions, makes a statement that subject FIR was investigated by the API of Shahupuri Police Station and police have arrived at a conclusion that complaint/report lodged by Respondent No. 2 is false and police propose to file B-summary report through Sub Divisional Police Officer, Kolhapur City, Kolhapur. In support of his submission, Mr. Yagnik placed on record report dated 1st August 2017 made by the API of Shahupuri Police Station, Kolhapur. patilsr 1 / 2
