IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO. 2134 OF 2009 IN FIRST APPEAL (ST) NO. 4253 OF 2009 Municipal Corporation of Greater Mumbai ...Applicant

Versus

Thomas Mathew & Anr

...Respondents

Mrs MR Bhoir, for the Applicant/Appellant-MCGM.

Mrs Sultana Sonawane, for the Respondent No. 1. CORAM: G.S. PATEL, J DATED:

1st August 2017 PC:- 1.

There is a delay of 337 days in filing the First Appeal. The delay is explained by some quite exceptional justifications given in paragraphs 6, 7 and 8 of the civil application: the MCGM's (and its officers') heavy work load, the large amount of typing and printing required, the many thousands of litigations in different courts, having to handle RTI queries, and consequently facing contempt actions in this Court for either taking or not taking action, as also on account of the MCGM and its officers being arrayed as respondents in innumerable PILs.

1st August 2017

21-CAF2134-09-D.DOC 2.

These reasons are, in my view, refreshing in their irresistible candour (to say nothing of their anodyne guilelessness), and must be accepted.

3.

The Civil Application is made absolute and disposed of accordingly. No costs.
