Heard learned counsel for the Applicant and learned APP for the Respondent - State.

By this application, the Applicant seeks his enlargement on bail. According to the learned counsel for the applicant, despite charge having been framed and 6 witnesses having been examined, the trial has not proceeded thereafter.

Learned APP states that the Court is vacant and there is a every

2/2 910-ba.312.2015.doc possibility that the matter will be transferred to the appropriate Court within a period of one month. She submitted that about 8 witnesses are yet to be examined in the said case.

Considering the fact that already 6 witnesses have been examined, and the matter is likely to be transferred to the appropriate Court, the prayer for bail is not being considered, at this stage. Once, the case is transferred, the learned Sessions Judge, to decide the case, as expeditiously as possible, as 6 witnesses have already been examined in this case.

Application is accordingly disposed of on the aforesaid terms. 6.

A copy of the order be forwarded to the applicant, who is lodged in Taloja Central Prison, through the Jailor.
