This is an application for anticipatory bail in C.R. No.395 of 2020 registered with Versova Police Station, Mumbai for offences under Sections 326, 324, 323, 504 & 506 r/w Section 34 of Indian Penal Code.

The case of the prosecution is that the applicant No.1 had assaulted the injured Naresh Sharma with bricks, whereas the applicant No.2 had assaulted Anita Sharma, Parvati Sharma, and Digitally signed by RajeP. Aher Date:
2021.02.24 14:26:16 +0530 RajeP.
Aher Geeta Sharma with cricket bat.

Cross cases were filed between both the sides. From the applicant's side C.R. No. 396 of 2020 registered with Versova Police
Station, for similar offences.

The accused in the cross FIR namely Rakesh, Naresh, Parvati had preferred application for anticipatory bail before this Court which has been allowed vide order dated 11th February, 2021. 5.
Learned APP pointed out the nature of injuries sustained by the injured in the present case. It is submitted that Naresh had sustained grievous injury and other injured person had sustained simple injury. Considering the fact that both the sides were assaulted and cross cases are registered against each other, the applicants need not be subjected to custodial interrogation. Hence, I pass the following order:
ORDER
(i) Anticipatory Bail Application No. 418 of 2021 is allowed;
(ii) In the event of arrest of the applicants in connection with in C.R. No.395 of 2020 registered with Versova Police Station, Mumbai the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- each with one or more sureties in the like amount;
(iii) The applicants shall attend the investigating officer on 1st 2nd 3rd March, 2021 between 11.00 a.m. to 1.00 noon . (iv) The applicants shall not tamper with the evidence in any manner.
(v) Anticipatory Bail Application stands disposed of accordingly.
