This is an application for hearing of the First Appeal on priority basis, considering the age of respondent No.1, who is a senior citizen. It is submitted that, earlier, on two occasions, the Appeal was fixed for hearing, but due to failure of the appellant herein to remain present, hearing of the Appeal could not take place.

Considering that the Appeal is of the year 1998 and respondent No.1 is a senior citizen, the Appeal is required to be fixed for hearing on priority basis. Accordingly, it is fixed for hearing on 27th September 2016, to be heard at 3:00 pm.
