1] The Applicant was admitted to protection from arrest by order dated 11.02.2022 and he was directed to report to the Investigating Officer on several occasions. He has accordingly abided with the directions.

2] The Applicant faces accusations that he has received a sum of Rs.13,54,096/- as he has collected the amount from various traders, but did not remit it to the complainant.

3] The learned APP states that during the course of investigation statements of various traders are recorded and material is collected during the investigation which would reveal that a sum of Rs.13,54,096/- is due and payable to the complainant. 1/2

(3)ABA-379-2022.doc 4] Since investigation is now complete and entire material is with the Investigating Officer, I do not think custodial interrogation is any more necessary. The Applicant will take the consequences of the offences of cheating and criminal breach of trust when he is subjected to trial.

5] In the wake of above, order dated 11.02.2022 is made absolute. 6] Needless to state that the Applicant shall continue to render his co-operation to the Investigating Officer.
