On expressing my disinclination to entertain the application in the wake of the material compiled in the charge-sheet, where the role of applicant has clearly surfaced, the learned counsel seeks permission to withdraw the application. Permission granted. Learned counsel would however request this court to direct the trial court to concluded the trial within a stipulated period, since the applicant is incarcerated since 23/05/2017, and despite charge being framed on 17/01/2019 the trial has not yet commenced. 2.
In the wake of the above, the Sessions Judge, Dindhosi, is requested to conclude the Sessions Case No. 316 of 2017 in any contingency within a period of one year from today. He shall make Ashish Mhaske
2/2 23 BA 553.20.doc every endeavour to fix the trial on day to day basis, since the prosecution is intending to examine 12 to 15 witnesses. In case if the trial is not concluded within the aforesaid period the applicant is at liberty to renew his request.
Application is disposed off as withdrawn.
