Pursuant to the praecipe filed by the learned counsel for the Applicant, the matter is taken on production board.

This Application is for condonation of 40 days delay in preferring the appeal challenging the judgment and award dated 10.10.2018 passed by the Commissioner for Workmen's Compensation and Judge, 2nd Labour Court, Thane in application (WCA) No.350/C-65/2013.

It is to be noted that the present matter was taken on production on 23.07.2019 for urgent orders, at the request of the learned counsel for the Basavraj G. Patil 1/2

513.762.19-CAF.odt Applicant. On that day, this court had directed the Applicant to serve the Respondent by private notice and file an Affidavit of Service. Without serving the Respondent, the learned counsel for the Applicant again got the matter on production today. Hence, I do not find any urgency in the matter.

Hence, following order is passed:

a.

The Applicant shall pay cost of Rs.1500/-.

b.

Cost shall be paid to the Kirtikar Law Library, High Court, Mumbai and place a receipt thereof on record on or before 05.10.2019, failing which the Civil Application shall stand dismissed without further reference to the court.

c.

The Civil Application to come up on board as per CMIS date and/or after service of all the Respondents.
