CORAM : A.M.BADAR J.

DATED : 23rd August 2017.

P.C. :

This is Application for condonation of delay of about 320 days in filing an Application for leave to challenge acquittal of Respondent No.2 of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.

Heard the learned Advocate appearing for the Applicant as well as the learned Advocate appearing for the Respondent No.2/original accused. Though the learned Advocate for the Respondent No.2 vehemently opposed the Application for condonation of delay by stating that no sufficient cause is made Gaikwad RD 1/2

(17)APPLNNo.962016 out for the same, I am satisfied that averments in the Application make out sufficient cause. Moreover the averments are not controverted.

Hence, for the reasons stated in the Application, the delay in filing Application for leave to Appeal is condoned. The Application is disposed of accordingly.

Put up the Application for leave to Appeal for admission on 7th September 2017, by consent of parties. (A.M.BADAR J.) Gaikwad RD 2/2
