The petition is filed seeking direction to transfer the investigation of C.R. No. 513 of 2016 with Malwani Police Station to any other senior officer of respondent No.2. Directions are also sought to respondent No.2 to produce the petitioner's daughter in this Court. 3.

The subject CR was registered at the instance of the petitioner for the offence punishable under Section 363 of the Indian Penal Code, 1860, on the allegation that Mohammad Israel Mohammad Yunus has Shubhada S Kadam 1/2

3 wp 582.17.doc kidnapped her minor daughter. During investigation, the investigating officer traced the accused and the victim. The accused was remanded to the custody. Since the victim-minor girl refused to go to her parents, she was kept in Home for Children at Dongri. Subsequently, the custody of the minor girl was handed over to the petitioner-mother. This fact is not disputed by learned counsel for the petitioner. The victim - minor child is present before the Court and learned counsel for the petitioner identifies her.

In the light of the above circumstances, learned counsel for the petitioner states that the grievance raised in the petition, no more survives and he seeks leave to withdraw the petition.
