At the outset, Ms. Kaushik learned APP appearing for the Respondent-State submits that Charge-sheet has been filed on 7th February 2024.

The present Bail Application is filed in this Court on 2nd February 2024 and thereafter Charge-sheet has been filed on 7th February 2024.

In view of the said subsequent development, Mr. Dalvi, learned Counsel appearing for the Applicant seeks leave to withdraw the Bail Application with liberty to file a fresh Bail Application before the learned Trial Court.

Accordingly, the Bail Application is allowed to be withdrawn and disposed of as such with liberty as aforesaid. 5.

It is made clear that this Court has not considered the merits.
