Mr. Mohite the learned counsel for applicants upon instructions makes a categorical statement that all the dues as shall be raised by the Regional Transport Authority in relation to the registration of the vehicles of the complainant including that of tax, fine, etc. will be deposited within a period of four weeks after such demand is brought to the notice of the Applicant either by the complainant, RTO Authorities or Investigating Officer.
In the above background, a case is sought to be made for grant of pre-arrest bail in Crime No.179 of 2016. Perused the papers, particularly, tax invoices and ledger account of A1 Auto Private Limited does not reflect receipt of alleged Shivgan 1/2
6-ABA-256-2016 amount of taxes, etc. to be received from the complainant through Swami Motors. In my opinion, custodial interrogation is not called for. Hence, in the event of arrest, the applicants shall be released on executing PR Bond in the sum of Rs.50,000/- each with one or two sureties in the like amount. They shall attend the Investigating Officer as and when called. They shall not tamper with the prosecution evidence and/or influence the prosecution witnesses. If the amount as demanded as has been observed hereinabove if not honoured by the present applicants, it will be open for the complainant or the prosecution to move for cancellation of bail directly before this Court.
Application stands disposed of as allowed.
