The writ petition challenges orders of Labour Court, Mahad and Industrial Court, Thane on a complaint under the Maharashtra Recognition of Trade Unions and Provisions of Unfair Labour Practices Act, 1971. 2.
The petitioner was appointed to the post of peon with the first Respondent Zilla Parishad. Subsequently, he was sought to be terminated on the ground that the original appointment was illegal. The main ground of such termination was that for the advertised posts, candidates were available from the select list. These candidates were duly appointed to the advertised posts and yet the petitioner, along with other wait listed Sam. Pg 1 of 2

Similar grievance on the part of these others has been considered by this court in Writ Petition No. 152 of 2016 filed by one Shraddha Sandeep Vengurlekar and others against Raigad Zilla Parishad and others. By an order dated 21st March, 2016, passed in that petition, the petition was dismissed. The reasons disclosed in the order equally apply to the present case, the revision order in which is common to the revision order which was challenged in that petition. In the premises, this petition is also dismissed for the reasons recorded in the order dated 21st March, 2016, in Writ Petition No. 152 of 2016, referred to above. No order as to costs.
