1] The petitioners have raised challenge to notice dated 25th January, 2016 issued by Respondent No.3 in exercise of powers under section 54(1) of the Maharashtra Regional and Town Planning Act. It is contention of the petitioners that application seeking regularisation of construction is already presented to the Planning Authority - Respondent No.2 and the same is still pending. In the circumstances, this petition can be disposed of by issuing direction to Respondent No.2 to take decision on the application dated 8th February, 2016 tendered by the petitioners under section 53(3) of the MRTP Act as expeditiously as possible and preferably within two months from today and it is, accordingly, directed. The writ petition is, accordingly, disposed of.
