Heard Mr.Lanjekar, the learned counsel for the applicant.

Pursuant to the directions given yesterday, the applicant is present in the Court.

In reply to a query put by this Court, it is admitted that the applicant had gone abroad, after the renewal of his passport, without taking any permission from the Court to depart from India. However, it appears that the applicant was not aware of the Gaikwad RD 1/2
907.APPANo.2022015 position that he would be required to take a permission of the Court before actually departing from India.

In the circumstances, this lapse on the part of the applicant is condoned.

After hearing the learned counsel for the applicant and the learned Additional Public Prosecutor, it is declared that this Court would have no objection, if the passport of the applicant is renewed for a period of five years.

The applicant shall, however, give an undertaking in writing to this Court, that he shall not depart from India without the express permission of this Court in that regard. 7.
