This is an application for bail in CR No.9 of 2019 registered with Vile Parle Police Station for offences under Sections 353, 332, 506, 504 r/w 34 of Indian Penal Code.

The applicants were arrested on 9th January 2019. The case of prosecution is that the applicants and the co-accused had obstructed policemen while they were discharging their duty while executing eviction proceedings. The co-accused who is lady aged about 76 years, has been granted anticipatory bail. The applicants are in custody from the date of arrest. Upon investigation charge sheet is filed. There are no antecedents against applicants.

Learned APP submits that the role of assaulting the policemen has been attributed to the applicants. However, considering the fact that applicants are in custody for substantial time and charge sheet is already filed against accused, their detention is not necessary. Hence, I pass following order :

ORDER

(i) Criminal Bail Application No.419 of 2019 is allowed and disposed off;

(ii) The applicants are directed to be released on bail in connection with CR No.9 of 2019 registered with Vile Parle Police Station on furnishing PR bond in the sum of Rs.25,000/- each with one or more sureties in the like amount;

(iii) The applicants shall attend Vile Parle Police Station once in two months, on every first Saturday falling after two months, between 11 am to 1 pm till further orders.
