This petition filed under Article 227 of the Constitution of India is directed against the order dated 16th April 2016 passed by the learned Judge, Civil Judge Junior Division, Wadgaon, by which the learned Judge has allowed the application for amendment filed by the plaintiffs. The plaintiffs had filed the Suit for a declaration, injunction and partition.

After hearing of the matter, the learned counsel for the petitioner, on instructions from the petitioner, who is present in the Court, seeks leave to withdraw this Petition. Leave is granted. Petition is allowed to be withdrawn and stands dismissed as such.

The learned counsel for the petitioner further submits that the matter be expedited.

The applicant, who is a purchaser of the property may move the application before the trial Court to expedite the matter and the trial Court may consider the same.
