The applicant / accused in Crime No.29/2015 for offences punishable under section 307, 326, 323, 504 and 506 of the Indian Penal Code, 1860 registered with Aundh Police Station, District Satara by this application is praying for his release on bail.

Heard learned counsel appearing for the applicant as well as the learned APP for the State. Perused the papers of investigation.

It is seen that on 21st July, 2015 injured Balu Shyamrao Sawant has lodged F.I.R. which has resulted in registration of the crime in question. According to the prosecution case, informant Balu is relative of the applicant / accused. There was a quarrel between the applicant / accused and his wife Asha and, therefore, he went to the house of the applicant / accused and tried to intervene. At that point of time, the applicant / accused had assaulted him by means of knife. When Shyamrao - father of the informant attempted to save his son, the applicant / accused also assaulted him by means of knife. Asha, who is wife of the applicant / accused was also injured.

Perusal of injury certificate of Shyamrao shows that he suffered one incised wound, two sharp cut injuries, out of which one was on the tempo parital region and another was at left pinna cartilage extending to left side of neck. Asha suffered simple injuries whereas Balu suffered two contused lacerated wounds.

Delay in disposal of trial is an important consideration for grant of bail. It is reported by the learned 2/3
APP that the trial is yet to begin. Pending the commencement of trial, detention of the applicant / accused cannot be endorsed. The prosecution has not expressed any apprehension that the applicant / accused will not be available for trial. Hence the order.
(i) Applicant / accused in Crime No.29/2015 for offences punishable under section 307, 326, 323, 504 and 506 of the Indian Penal Code, 1860 registered with Aundh Police Station, District Satara be released on bail on his executing P.R. Bond in the sum of Rs.10,000/- with one or more surety in the like amount;
(ii) As a condition of this order, the applicant / accused shall not tamper the prosecution evidence in any manner and he shall attend each and every date of hearing before the learned Sessions Judge and shall co-operate for expeditious disposal of the trial;
(i) The application is disposed of accordingly.
