At the outset, learned Counsel for the applicant seeks leave to amend to implead the prosecutrix as party respondent no.2, without naming her. Leave granted. Amendment to be carried out within two weeks.

On amendment being carried out, notice be issued to the respondents, returnable on 20th February, 2023.

Learned APP waives notice on behalf of respondent no.1 - State. In addition to Court notice, applicant to serve the respondent no.2 by private notice and file an affidavit of service before the returnable date.

Learned Counsel for the applicant to supply spare copy in the Registry within two weeks from today, so as to enable the Registry to issue notice to the respondent no.2, failing which, application to stand dismissed for non-prosecution, without further reference to the Court.
