Petitioner prays for transferring investigation from Ambad Police to some other investigating authority. The accused assaulted the injured who suffered serious injuries. The grievance is that police filed charge-sheet for offence punishable under Section 325 of the IPC. The petitioner seeks direction to apply provisions of Section 307 of the IPC. Without expressing any opinion, we observe that the learned trial Judge would take appropriate view while taking cognizance/framing charge in respect of the subject offence.
