1) The learned APP on instructions from the Investigating Officer who is present in the Court submitted that in pursuance of Order dated 10.2.2016, the applicant attended the Investigating Officer. The learned APP on instructions submitted that the custodial interrogation of the applicant is not necessary. I have perused the papers pertaining to the investigation. 2) It appears from the record that the co-accused namely Devendra R. Rai was arrested by police and he was custodially interrogated. It further appears that during the course of his custodial interrogation, the police have unearthed the facts leading to the present crime. Therefore, I am of the
Dond 2/2 aba.261-2016.sxw opinion that the custodial interrogation of the applicant is not necessary. 3) In view of the above, interim relief granted by Order dated 10.2.2016 is hereby confirmed.
