By this Petition under Article 227 of the Constitution of India, petitioner-husband has challenged the judgment and order dated 27.11.2015 passed by the learned Judge, Family Court No.2, Mumbai below exhibit13 in Petition No.A-1195 of 2013. By that order, the learned Judge allowed the application exhibit-13 made by the respondent-wife and directed the petitioner to pay an amount of Rs.7,000/- per month towards interim maintenance from the date of filing of the application i.e. 28.11.2013. Petitioner is also directed to pay Rs.500/- per trip towards traveling expenses to the respondent whenever she was present in the past and will remain present in future.

After arguing the Petition for quite some time, Mr. Tajane, upon taking instructions from the petitioner, seeks permission to withdraw this Petition. He further submits that having regard to the fact that matrimonial dispute is between the parties, the learned Judge of Family Court may be directed to dispose of the Petition in a time bound manner.

On the motion made by Mr. Tajane, Petition is allowed to be withdrawn and is dismissed as withdrawn. Liberty is reserved to the parties to apply for disposal of the Petition in a time bound manner. If such application is made, the learned Judge will pass appropriate order. Order accordingly.
