IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION Amk CRIMINAL WRIT PETITION NO. 994 OF 2020 Samadhan @ Chandu Ishwar Patil .. Petitioner Vs.

The State of Maharashtra .. Respondent None for the Petitioner.

Mr. S. R. Shinde, APP for the Respondent-State. CORAM : B. P. DHARMADHIKARI, A.C.J. & N.R. BORKAR, J.

DATE : 27 th FEBRUARY, 2020.

P. C. :

1.

Parole leave was rejected on 20.09.2019 and appeal against which has been dismissed on 14.01.2020. Reason is of adverse police report. Leave was applied for on 05.07.2019 and before that on the ground of illness of mother. The authorities found police report adverse. 2.

Nominal roll shows that from the date of commission of offence the prisoner is in jail and as such the apprehensions expressed are based upon imagination.

3.

However, certificate about illness of mother is now more than 9 months old. We, therefore, grant prisoner leave to file fresh application if cause still subsists with proper medical certificate. If such certificate and request is made within two weeks from today, the 1/2

(17) WP 994-20 concerned authority shall look into it in the backdrop of observation made supra.

4.

The Petition is, accordingly, disposed of.

5.

Order be served upon the prisoner in jail.
