This is a second application for bail. The earlier application was allowed to be withdrawn with liberty to prefer a fresh application before this Court, if the trial does not conclude within six months.

Learned advocate for applicant submitted that the trial has not yet commenced. The applicant is twenty years old and required to pursue his studies. It is further submitted that there is no evidence to constitute an offence u/s 302 of Indian Penal Code. 3.
Learned Special Public Prosecutor, on instructions of the officer who is present in the Court, submitted that the prosecution intends to examine about nine witnesses. It is further submitted that the charge has been framed. He pointed out the roznama to submit that the trial was delayed by accused. 2 of 2 1.BA.391.2018.doc trial will be concluded within three months from today. In the circumstances, I am not inclined to allow this application at this stage. Bail Application No.391 of 2018 is dismissed. 4.
The Trial Court shall complete the trial within three months from the date of receipt of a copy of this order. If the trial is not concluded within three months, the applicant will be at liberty to move an application for bail.
