The present application is filed by the Applicant from Yerwada Central Prison, Pune in connection with C.R. No.477 of 2015 registered with Kondhwa Police Station, Pune.

Perusal of application indicates that, it is the grievance of the Applicant that, he is behind the bars for about four years. That, the police have falsely implicated him in the present crime. That, the concerned Public Prosecutor appearing in the said trial is unnecessarily procrastinating the hearing of the trial and is not cooperating with the concerned Court in expeditious hearing of it. The Applicant has prayed that, necessary directions may be issued to the concerned Public Prosecutor and the Applicant may also be released on bail.

Learned A.P.P., on instructions submitted that, the trial of the MCOCA Special Case No.21 of 2016 wherein the Applicant is an accused, has already commenced and as of today the prosecution has examined seven witnesses. She, further on instructions submitted that, the prosecution is intending to examine approximately ten more witnesses in support of his case. 4.

In view thereof, the application of Applicant for bail need not be considered at this stage.

The learned Special Judge, under MCOC Act, Pune, seized of MCOCA Special Case No.21 of 2016 is directed to expedite the hearing of the said case and to make an endeavor to conclude the same on or before 30th June, 2022.
