Heard.

The Writ Petitions are disposed of with the consent of the learned counsel for the parties on the following terms: (i) The respondent no. 1-management will hold the denovo enquiry against the petitioners in accordance with law. (ii) The respondent no.1/management would be entitled to incorporate additional charges for the alleged misconduct of the petitioners after issuance of the charge-sheet in the previous enquiry till date, if any.

(iii) The petitioners shall not claim any back wages till date, till the enquiry is culminated and the decision in the enquiry is taken. The said issue is, however, kept open and the petitioners can raise the same at an appropriate stage, if desired.

(iv) During the pendency of the enquiry proceedings, the petitioners shall be deemed to be suspended employees and the respondent no. 1/management shall pay the subsistence allowance to the petitioners in accordance with law. (v) No costs.
