The above Petition has been filed seeking direction that since the term of the Managing Committee of the Respondent No.4/Society has come to an end as long back as in the year 2015, an Administrative Committee be appointed on Respondent No.4 Co-operative Society by exercising powers under The Multi-State Co-operative Societies Act, 2002. In our Nesarikar
2 / 3 view, having regard to the relief sought, it would be appropriate if the Petitioner makes a representation to the Central Registrar, i.e. the Respondent No.3, herein and the Central Registrar considers the said representation within a particular time frame. Hence the following directions:
(1) The Petitioners to make a representation to the Central Registrar, within a period of four weeks from date.
(2) The Central Registrar, may decide the said representation within four weeks of the receipt of the same.
(3) A copy of the said representation should also be served upon Mr.Y.R. Mishra, Senior Group-1 Panel, Counsel of the Central Government, who would also forward the same to the Central Registrar.
(4) On receipt of the said representation, the Central Registrar, may take appropriate decision in accordance with law, either directing holding
3 / 3 of the elections or such other action as he deems appropriate.
(5) Needless to state that the decision of the Central Registrar would be without prejudice to the rights and contention of the parties.
(6) With the directions as aforestated, the above Writ Petition is disposed of.
