First Appeal Stamp No.25342 of 2000 came to be rejected for non depositing of Deficit Court Fee.

Learned AGP points out that in fact the Deficit Court Fee was paid on 25th August, 2005 however, the same could not be pointed out and thereafter additional Court fee was also deposited and a Stamp No.670 of 2005 was given. But the same could not be pointed out to the Registry. For the reason the First Appeal stands restored to its original status. Manoj

Learned AGP informed that in the Appeal challenge is to an enhancement of the amount of compensation by the Learned Reference Court i.e. Extra Joint District Judge, Pune in L.A.R. No.17 of 1985 along with other references by way of common Judgment & Order. Learned AGP submits that the Learned SLAO had awarded an amount of Rs.7,290/-. The same came to be enhanced to Rs.18,824/-. Enhancement is thus within four times of the amount awarded by the SLAO. 4.
Learned AGP thus submits that in view of the GRs dated 3rd November, and 11th May, bearing No.Sankirn-2014/P.K.41/part-1/A-4, he seeks leave to withdraw the Appeal.

Leave is granted.

Appeal is disposed of as withdrawn.

In view of withdrawal of the Appeal, pending Civil Applications, if any, stand disposed of.
