By order dated 22.2.2016 sentence awarded to the Applicant was suspended till the adjourned date on the Applicant depositing Rs.1,25,000/- in the lower Court. The learned advocate for the Applicant submitted that the said order has been complied with. Learned Advocate further submitted that during the pendency of the Appeal before the Sessions Court, the Applicant had deposited

2/5 an amount of Rs.1,20,000/-.The total amount deposited by the Applicant is Rs.2,45,000/-. The cheque amount was Rs.4,00,000/- and compensation awarded by the trial Court was Rs.4,25,000/-. In view of compliance of order dated 22.2.2016 the sentence imposed upon the Applicant is required to be suspended and the Applicant deserves to be granted bail.

Hence,I pass the following order :

O R D E R

(i) The sentence of imprisonment awarded by the Court of Metropolitan Magistrate, 43rd Court, Borivili, Mumbai vide judgement and order dated 3.5.2014 passed in C.C No.109/SS/2008 is suspended pending Revision Application preferred by the Applicant.

(ii) The Applicant is directed to be released on bail on furnishing P.R.Bond in the sum of Rs.25,000/- with one or more sureties in the like amount.

Application stands disposed of.
