JOSHI, I/c.REGISTRAR (JUDL - II) Date : 23rd February, 2017 On verification of cause title of First Appeal and its Civil Application with title of original proceedings, it is seen that address of Respondent Nos.1 to 3 are one and the same. The Notice issued to Respondent Nos.1 to 3 is returned unserved with remark "Not found and no one knows any information about said Respondents". Respondent Nos.1 to 3 were Defendants before the City Civil Court, Mumbai and ex-parte judgment was passed. Hence, there is no other way to serve Respondent Nos.1 to 3 except by way of Publication of Notice in "Free Press Journal (English Newspaper) and in Navshakti (Marathi Newspaper) circulated in Navi Mumbai as mentioned in prayer clause of Civil Application.

In view of this, Civil Application is allowed in terms of prayer clause (a).
