caw-730.17.odt was dismissed for non-prosecution on 10 th January, 2017. The objection of the learned counsel appearing for the first respondent is that nothing survives in the Petition.
The Petition was dismissed for non-prosecution. The reasons for absence of the Advocate for the applicant have been set out in the application. Hence, a case for restoration is made out. All objections raised by the respondents can be considered at the stage of admission.
Accordingly, the application is allowed in terms of prayer clause (b). Place the Petition under the caption of "Fresh Admission" on th April, 2017.
