Registrar (Judicial-I) has placed present Application for 'Speaking to the Minutes' of Order dated 26th November 2021, rather for recalling of the said Order.

It is pointed out that, the Criminal Bail Application No.1487 of 2020 was filed by the Applicant for releasing him on bail in respect of C.R. No.118 of 2019 registered with RCF Police Station, Mumbai under Section 420 r/w 34 of the Indian Penal Code through Advocate Shri Harshad Bhadbhade. 3.

Present Bail Application No.583 of 2020 is filed by the Applicant in connection with C.R. No.213 of 2018 registered with Tilak Nagar Police Station, Mumbai for the offence punishable under Section 419, 420, 465, 467, 468, 471 read with 34 of the Indian Penal Code. 1/2

It is thus clear that, both the said Applications are filed for bail in different crimes and not in the same crime as has been erroneously recorded in Order dated 26th November 2021.

In view thereof, the observation made in sub para 2 of para No.3 that, the Applicant had suppressed the material facts from this Court is erroneous.

As a consequence thereof, notice issued to the Applicant as per para No.4 of Order dated 26th November 2021 is hereby cancelled and the said Order dated 26th November 2021 is recalled.

At his stage, learned A.P.P. submitted that, Applicant has already been released on bail in present crime i.e. C.R. No.213 of 2018 registered with Tilak Nagar Police Station, Mumbai by an Order dated 14th September 2020 by the learned Additional Sessions Judge, City Civil & Sessions Court, Greater Mumbai in Criminal Bail Application No.1705 of 2020. 6.

In view thereof, present Application has become infructuous and is accordingly disposed off.
