Heard the learned counsel for the parties. As the impugned order does not record even reasons in brief, the learned counsel appearing for the first respondent, on instruction from Mr.Makarand D. Nikam, Executive Engineer, states that the appropriate officer of the first respondent- Municipal Corporation will give a fresh hearing to the parties and, thereafter, pass a fresh order. He states that brief reasons will be recorded in the order.

We accept the said statement. As the impugned order dated 2nd February 2018 stands withdrawn, nothing survives in this petition. The Petition is disposed of.

A fresh order shall be passed by the appropriate Officer of the Municipal Corporation as expeditiously as possible and preferably within a period of six weeks from today.

We make it clear that we have not made any adjudication on the merits of the controversy involved.
