Heard learned counsel for the petitioner and learned APP for the State. In pursuance of the notice issued by this Court on 29th March, 2017, respondent No.8 is present before the Court. 2.
The petition is filed seeking writ of habeas corpus directing respondent Nos.1 to 8 to produce the petitioner's mother named Smt. Pramila Vasant Gorhe. The petitioner and respondent No.8 are real brother and sister. The petitioner does not dispute that his mother is with respondent No.8.

Learned APP has placed before this Court a report dated 24th April, 2017, of the Police Inspector (Administration), Panvel City Police Station. Perusal of the report reveals that the police personnel visited the house of respondent No.8 and have recorded the statement Shubhada S Kadam 1/2
33 wp 608.17.doc of petitioner's mother on 25th February, 2017. The said statement of the petitioner's mother is also placed before us for our perusal. The statement of the petitioner's mother discloses that she at her own will is residing with her daughter- respondent No.8. The statement further discloses that the petitioner's mother has filed 3 NC complaints against the petitioner as the petitioner is troubling her. Both the aforesaid report and the statement are returned to learned APP upon perusal. 4.
It appears that there is a dispute between the petitioner and respondent No.8 in respect of the property owned by their mother. The petition is, therefore, misconceived and is, accordingly, dismissed. (SMT. ANUJA PRABHUDESSAI, J.) [RANJIT MORE, J.] Shubhada S Kadam 2/2
