The petitioner is a State Government employee. By instituting this writ petition on February 21, 2020, he seeks a direction to the respondent no. 2 to decide his representations dated April 16, 2019 and October 16, 2019. He also prays for quashing and setting aside the communications dated July 15, 2019 and October 23, 2019. 2.

Mr. Pabale, learned AGP appearing for the respondents objects to the maintainability of the writ petition. According to him, the petitioner ought to pursue his remedy before the Maharashtra Administrative Tribunal (hereafter 'the Tribunal', for short) first.

At this stage, learned advocate for the petitioner seeks withdrawal of the writ petition with liberty to move the Tribunal.

The writ petition stands dismissed as withdrawn, with liberty as prayed for. No costs.

Needless to observe, the period during which this writ petition was pending on the file of this Court shall be excluded for the purpose of computing limitation, if at all the petitioner approaches the Tribunal.
