This Application is moved for relaxation of condition No. (iii) which was imposed by this Court by order dated 16th December, 2016 in Criminal Anticipatory Bail Application No. 2146 of 2016. By the said condition, this Court has directed the applicant/accused to stay out of jurisdiction of Trimbakeshwar Police Station till the filing of the charge sheet.

The learned counsel for the applicant/accused has submitted that the house of the applicant/accused is within the jurisdiction of Trimbakeshwar Police Station. The applicant/accused was not the main assailant in the offence, i.e., under sections 143, 147, 148, 149, 1 / 2
10.APPP124_2017.doc 324, 332, 336, 337, 341, 353, 427, 435 of the Indian Penal Code, under sections 3 and 7 of Prevention of Damage to Public Property Act and under section 135 of Maharashtra Police Act. 3.
Learned APP opposed the Application and points out that there are nearly 258 accused and the police are investigating the matter. It is further submitted that the incident took place due to tension between the two communities.

Considered the submissions. Perused the order and the FIR. Condition No. (iii) shall be in force till 15th April, 2017 and it is relaxed from 16th April, 2017.
