After hearing Mr. Anil Singh, learned Additional Solicitor General and Mr. Desai, learned Senior Counsel for some time, at 6.45 p.m. Mr. Desai, learned Senior Counsel, on instructions, informed this Court that the respondent - Mr. Kapil Wadhawan has already been released from Arthur Road Jail after furnishing cash bail.

Mr. Singh, learned Additional Solicitor General, on instructions from the Officer of the applicant, who is present in the Court, submits that the statement made across the bar is correct. 3.
In that view of the matter, this application has become infructuous. The applicant is at liberty to move fresh application in accordance with law.
