CORAM : M. S. KARNIK, J.
DATE : APRIL 26, 2024 P.C. :
1.
Heard learned counsel for the applicant.
2.
These are the applications for modification of the condition no. (d) regarding reporting to the Investigating OfÏcer as imposed vide order dated 16/01/2023 passed by 1/3
this Court.
3.
The applications are opposed by Shri Shirsat, learned counsel for the respondent no.1. By order dated 16/01/2023 in the 3 C.Rs. which are registered against the applicant, this Court had imposed the following condition no. (d) in respect of which the modification is sought.
"(d) The applicant shall report to the Investigating OfÏcer of the concerned police station once in fifteen (15) days of every alternate 1st and 3rd Saturday of the month between 11.00 a.m. and 2.00 p.m. commencing from February 2023."
4.
I have perused the afÏdavit in reply filed on behalf of the respondent no.1. The applicant is regularly attending the Investigating OfÏcer in terms of the condition no. (d) for more than a year and two months. The applicant does not appear to be a flight risk or it is unlikely that he would evade the trial. The applicant is from Rajasthan. 5.
For the reasons mentioned in the applications, I am inclined to modify the condition no. (d).
6.
The applicant shall now report to the NCB OfÏce once in three months on first Monday of the concerned month between 11.00 a.m. and 1.00 p.m. commencing from June 2024.
2/3
7.
The applicant to attend the trial regularly.
8.
Rest of the conditions shall remain intact.
9.
The applications are disposed of.
